Professor Martin Malin receives Public Sector Labor and Employment Attorney of the Year Award
Professor Martin Malin, director of the Institute for Law and the Workplace at Chicago-Kent College of Law at Illinois Tech, is the recipient of the ABA's 2016 Arvid Anderson Public Sector Labor and Employment Attorney of the Year Award. Professor Malin accepted the award at the 10th annual conference of the ABA Labor and Employment Law Section on November 11 in Chicago.
Established in 2009, the award recognizes an attorney whose career has substantially contributed to the development of public sector labor law as exemplified by Arvid Anderson, who pioneered the practice of labor law for public sector employees at both the state and local levels.
Professor Malin, who joined Chicago-Kent's faculty in 1980, is vice president of the National Academy of Arbitrators, a member of the Board of Governors of the College of Labor and Employment Lawyers, and a member of the Board of the North American Branch of the International Society for Labour and Social Security Law.
In October 2009, President Obama appointed Professor Malin as a member of the Federal Service Impasses Panel, which resolves impasses in collective bargaining between federal agencies and unions that represent their employees. He was reappointed in January 2014.
In addition, Professor Malin is a former national chair of the Labor Relations and Employment Law Section of the Association of American Law Schools, a former secretary of the ABA Section on Labor and Employment Law, a former member of the Board of Governors of the National Academy of Arbitrators, and a former member of the Executive Committee of The Labor Law Group.
From 2003 to 2008, Professor Malin served as reporter for the Association of Labor Relations Agencies Neutrality Project, which produced a treatise on labor board and mediation agency impartiality. Professor Malin was a consultant to the Illinois public sector labor boards from 1984 to 1986 and drafted the regulations implementing the newly enacted Illinois public sector labor laws. Professor Malin is founder and chair of the annual Illinois Public Sector Labor Relations Law Conference.
Professor Malin is the lead author of Public Sector Employment: Cases and Materials (West 2004, 2nd ed. 2011, 3rd ed. 2016), the leading law school casebook on public sector labor and employment law, as well as five other books. He is co-editor of the Illinois Public Employee Relations Report.
Professor Malin has written numerous scholarly articles on public sector labor law. The first of those articles, Implementing the Illinois Educational Labor Relations Act, 61 Chicago-Kent Law Review 101 (1985), has been cited numerous times by the Illinois Educational Labor Relations Board and the Illinois courts. His path-breaking study of public employee strikes, Public Employees' Right to Strike: Law and Experience, 26 University of Michigan Journal of Law Reform 313 (1993), has garnered significant national attention. With support from a Haynes Foundation grant, Professor Malin and Professor Charles Taylor Kerchner of Claremont Graduate University co-authored Charter Schools and Collective Bargaining: Compatible Marriage or Illegitimate Relationship, 20 Harvard Journal of Law and Public Policy 885 (2007).
In 2009, Professor Malin gave the prestigious William R. Stewart Lecture at Indiana University–Bloomington on The Paradox in Public Sector Labor Law, later published in volume 84 of the Indiana Law Journal (2009).
Professor Malin also serves as an arbitrator and mediator of union-employer disputes. He recently mediated the collective bargaining negotiations between the Chicago Teachers Union and the Chicago Board of Education.
